Dottely Users' Terms & Conditions

  1. Introduction

1.1. Welcome to Dottely, a Platform that gives you the chance to search and trace available Marketing Technology Software tools (the Marketing Technology Software tools or the Marketing Software toolsor “the tools that are available globally (Dottely or Platform).

1.2. Dottely is owned and operated by DOTTELY SINGLE MEMBER COMPANY”, with business address 3rd September Street 144, 11251, Athens Greece, e-mail [[email protected]] (the Company or “We”).

1.3. The following terms and conditions (Terms and Conditionsor T&Cs) that govern the browsing and use of Dottely, form a single document along with Privacy Policy and Cookie Policy of Dottely and are addressed to users who visit Dottely (Users or You). Visit and use of the content included in our Platform is governed by these Terms and Conditions.

1.4. We urge you to read the T&Cs carefully before browsing Dottely using our tools, or interacting with Dottely in any way.

1.5. When you browse, access, or use any tool of Dottely you agree to be bound to these T&Cs. In case you disagree with our T&Cs partly or as a whole or with any of the aforementioned documents that constitute an integral part thereof, then we urge you to cease to browse and access Dottely and avoid interacting with it in any way.

  1. Which is the Dottely way?

2.1. Dottely is a “Marketing Technology Software toolssearch engine that:

a) gives you the opportunity to find out available Marketing Technology Software tools by searching through our search engine tool in order to find information about Marketing Technology Software tools (subject to our listing criteria set below art 4.1. and to result on who is your preferred one, based on your own needs),

b) allows you to visit a Marketing Technology Software tool supplier information as a repository or visit its website by clicking on the link (where available),

c) offers you the ability to write a review in order to evaluate a marketing technology software tool you have chosen when you complete the prerequisite of art. 3 par.1 b) below,

d) offers you the ability to provide scoring of the Μarketing Technology Software tools.

All the above referred from now on as the “Services”.

2.2. Listing criteria: Dottely has collected, curated, dotted, and linked the Marketing Software tools in order to facilitate your search and made available summaries of essential information about them (“Listings”) to every visitor of Dottely. We have made the best possible effort to include the majority of the Marketing Software tools that are publicly available and to keep that list updated at all times; however, we cannot guarantee that the list is full and complete with all available Marketing software tools globally. In case you consider that a tool is missing we urge you to contact us at [email protected] to inform us accordingly.

In a nutshell, the criteria for the listing of the tools are:

a) Featured Listings
b) Ratings &   Reviews
c) Alphabetical Order

*Further information on the above can be found in article 4.1. below.

2.3. Dottely does not constitute a seller of the Marketing Technology Software tools listed in the Platform. To create a solid idea for the market involved, Dottely, as merely a host provider of the content related to those tools, has relied on:

a) either publicly available online content and/or
b) content that has been created by the supplier of those tools in specific for the purposes of  Dottely, forming a comprehensive guide, after becoming a Registered Vendor.
We cannot and we do not guarantee that information regarding those tools is accurate or fit for a specific purpose; Dottely does not bear responsibility regarding the accuracy and the truth of that content nor of its validity or lawfulness. In case you wish to make a complaint regarding that content please see our Notice and Take Down process below on art. 8.

  1. Who are our users?

3.1. Our Users are visitors of the Platform who would like to get informed about Marketing Software tools and are divided in two categories:

a) Platform Users: All Platform Users are able to browse Dottely and have access to our website, to search through our search engine. 

b) Users Providing Ratings & Reviews: You are able to introduce reviews on the software tools that appear on Dottely, after following the confirmation of your e-mail address procedure and (optionally) providing your name, if you wish it to appear on the review. You can find more information on how you can introduce such reviews on our “Users Providing Ratings & Reviews’ Guidelines” in Art. 6 below.

Both referred from now on as “Dottely Users” or “Users.

3.2. Other users of the Platform are companies/providers of the Marketing Software tools that register to create a Vendor Account in the Platform (“Registered Vendors) that can take control of their listings and content and perform campaigns in order to affect the as referred in more details in Vendor TCs. 

  1. Listing – Ranking of Marketing Software tools

4.1. Marketing Software tools appear as a list on Dottely (“Dottely Ranking List”) under the criteria mentioned below:

a) Featured Content appears at the top.
b) Ratings - based on ratings (stars) provided by Users, Listings are ranked from better to worse (more to fewer stars overall).
&
c) Reviews - based on the number of user reviews, Listings are ranked from most to fewer reviews*.
d) Alphabetical Order- based on the name of the tool (A-Z), after the aforementioned criteria have been taken into account.

* In general, ratings are calculated as the result of the multiplication of stars with the number of reviews.

4.2. Dottely Users can also choose the way the Dottely Ranking List is displayed by:

a) selecting one of the categories included in the relevant list or
b) opt to view the default way of displaying the list of the Marketing Software tools, based on the aforementioned criteria and categories selected by the Platform, as well as any other criteria that may be added by the Platform in the future (the "Classification"). Filters can be activated by clicking on the relevant icons provided.

4.3. The Platform reserves the right to agree to special terms with vendors who wish to promote their Marketing Software tools through Dottely. The aftermath of such promotional agreements may affect the position of a Marketing Software tool in the Classification.

4.4. Dottely reserves the right to delete from its list any product for legal reasons and/or contractual reasons based on its internal agreement with the Registered Vendors according to Dottely Delisting Terms.

4.5. How does our Platform work in more detail:

(i) Our Platform displays the categories of tools listed in Dottely from time to time. If you wish to choose the relevant Marketing Technology Software tool or category, the software providers of each category appear on your screen, with a small description of the tool, its ratings, its reviews, and (where available) the relevant link that gives you the opportunity to redirect to the website of the vendor/product. If you wish to read more, another page appears with information on the tool vendor.

(ii) To help you with your choices we have introduced filters that distinguish the Marketing Software tool based on additional characteristics (“Filters”). In case you do not choose Filters, then all the tools available in the relevant category shall appear by default as laid down in the Dottely Ranking List.

(iii) You can also shortlist the Marketing Software tool you prefer and see the relevant details and/or (where available) visit the webpage of the company that provides it.

(iv) In addition, you can compare the Marketing Software tool you have chosen with other tools at the comparison tool we provide you.

  1. How can Users provide Ratings & Reviews?

5.1. Dottely gives you the chance to evaluate the products that appear as a search result by becoming a Registered User and by choosing to review a certain Marketing Software tool.

5.2. To be able to submit your review of the Marketing Technology Software tools listed in Dottely, you need to provide us with a) the category of the tool, b) your ratings on the tool, c)metrics on questions depicted on the form regarding your personal experience, d) metrics on recommendations, e) the purpose you use it, f) rating on surveys and e-mail, g) the industry you belong to, h) organization size -how many employees does your organization have, i) your position level,  j) how long have you been using the tool, k) other software considered, l) your email address. In addition, you need to declare and warrant us that you are a current or past user of the tool as well as that you are not associated with the company at any other level (e.g. employee, former employee, relative, competitor, etc). The aforementioned information is mandatory in order to submit your rating & review. If these fields are not completed/selected your review will not be submitted to Dottely. Dottely reserves the right to remove all reviews from users who are proven not to have used a certain tool or to be affiliated with the company they review.

5.3. The fields regarding your:  a) name and b) comments asked in the dedicated fields are optional. Noted that, though you introduce our full name and surname, it shall appear truncated ( e.g. Costa l.) 

5.4. Dottely collects reviews under the Users Providing Ratings & Reviews statement that: a) they have already used the Marketing Software tool and b) the time period they have used it in order to display objective reviews. Vendors are not allowed to provide reviews for their own tools or the tools they promote.

5.5. Dottelly does not have the capacity to check or verify either the identity of the Users’ Providing Reviews nor their current or past experience of the tool; this information is used by the Company based on the statement of the User.

5.6. When you upload a rating & review, your following data will be publicly visible to all other Users: ratings, comments- if any, name truncated, Industry, Organization Size, Position Level, if you are a current or past user of the software, how long you are using the software, ratings and your comments- if any. If you do not choose to leave an eponymous review, the sign “Reviewer Verified” shall appear next to the review.

5.7. When you insert your professional e-mail in the dedicated field, you warrant us that the data you provide us are accurate, correct, true, complete, and up-to-date and that you are lawfully disclosing them to us.

5.8. After sending us your professional e-mail, a confirmation process shall follow; we will send you a confirmative e-mail with a verification link included in the professional e-mail you introduced in the dedicated field or the review form. Only as soon as you click on the link sent, your review will be published.

5.9. Each time you wish to upload a rating & review, the above process must be followed.

5.10. By introducing and confirming an e-mail address you warrant that the confirmed e-mail is professional, it belongs to you, and that you are the sole person with access to it. In addition, every User is responsible for retaining the secrecy and non-disclosure of his/her e-mail account or password to third parties.

5.11. Any act and/or omission through the User e-mail (including, but not limited to, the posting of reviews, etc) shall be reasonably considered by the Platform as the act and/or omission of the owner of the e-mail address, conducted by him/her and/or with his/her prior approval and shall be binding on that User.

5.12. Vendors will have the opportunity to respond to the reviews you make.  

5.13. Software ratings as a percentage depend on your reviews that are tied with a metric system. We extract the sum of reviews’ metrics using an algorithm in order to calculate the percentage of Ratings & Reviews.

5.14. The Platform will not be liable for any acts or omissions by Users, including any damages of any kind incurred as a result of such acts or omissions, and, where applicable, shall reasonably rely on the warranties and representations of the Dottely User referred to in art. 5.6 above, as well as articles 6 and 7 below.

5.15. You are able to delete reviews whenever you wish by sending an e-mail via your confirmed e-mail at  [email protected] with a request to delete one or more specific reviews posted by you. In case a Vendor has replied to a deleted review, the reply shall be deleted, too. Hence, all your reviews remain in the Platform, under the license of articles 7.3 b) and 8.1 below, unless you address to us a specific request to take down those reviews.

5.16. The Company also reserves the right at any point in time, without compensation, to delete a User's review, if it finds out that a User does not meet the requirements set in the Platform or violates these terms and or any applicable laws. In case of deletion of a User’s review due to the above, the Company will send an informative e-mail to the User.

5.17. We underline that the ratings & reviews are introduced only by Registered Users and Dottely does not evaluate any Marketing Software tool.

  1. Users Providing Ratings & Reviews’ Guidelines - Introduce a Rating & Review

6.1. You empower Dottely when you choose to evaluate the software tools presented and introduce reviews as current or past users of the tool; in addition, you help other Users obtain enriched information on the software tools we display. Furthermore, reviews provide feedback to vendors on the software and the services they provide and give them the opportunity to ameliorate their products. Thus, you need to introduce objective and specific reviews. Dottely does not (and is under no legal obligation to) review the reviews that Users upload to the Platform.

 6.2. However, reviews must follow the rules set in this article and article 6 and Platform reserves the right to delete a review, if it determines in its discretion that there is a violation and/or in case it receives a Takedown Notice pursuant to art. 8 below or as otherwise determined by applicable laws.

 6.3. In any case the Platform may, prior to uploading the reviews proceed to a high-level review for consistency and obvious infringement purposes; the above process is subject to the Platform’s own discretion when it considers that any comment is infringing and/or violates the rules set in art. 7 below. In such cases too, the Company does not control or initiate in any way the third-party content, and its actions are only limited in the aforementioned high-level review.

6.4. Dottely shall in no manner be liable for any damage caused as a result of the reviews uploaded and/or ratings provided by any User or Vendor, as well as in case it takes down any Content uploaded in violation of article 7 below or further to a Takedown Notice mentioned in art. 8. Dottely does not endorse nor in any way represent any opinion expressed by the Dottely Users or Vendors through the comments introduced. Dottely bears no responsibility for any loss or damage that may be caused to any third party and/or User due to the views of the Users Providing Ratings & Reviews.

  1. User responsibility for any type of content submitted in the Platform (Reviews or ratings or any other content allowed to upload in the Platform from time to time overall the User Generated Content or UGC):

7.1. Users Providing Ratings & Reviews bear the responsibility for that User Generated Content created and/or uploaded in reviews on Dottely. If you are a User Providing Ratings you must take all prudence not to upload any User Generated Content that contains illegal or offensive material or violates these Terms and Conditions nor any other guidelines posted in the Platform and statement undertaken by the User with regard to that UGC.

7.2. Our Platform does not participate in the creation of User Generated Content; it does not initiate, nor does it have any knowledge, nor control, nor agrees over any User Generated Content as described above.

 7.3. By submitting any UGC to be uploaded to the Platform, you represent, warrant, and agree to the following:

(a) All UGC submitted in the Platform does not infringe third-party rights; you are in compliance with and shall continue to comply with all laws, rules, and regulations applicable for the use of the Platform and the uploaded UGC, including but not limited to applicable copyright, unfair competition, and data protection laws;

(b) You are either the copyright owner of the UGC or have the lawful right to upload such UGC to the Platform and to provide a license agreement to the Platform in order to host the Content and make it available to the public through the Platform under the provisions set forth herein and use it in order to extract ratings on the Marketing Technology Software tools that appear on Dottely as described above.

(c) You acknowledge that the UGC generated and posted by you represents your own personal (non-professional) views, evaluation, and opinions and not the Platform’s opinions or views;

(d) You are responsible for mentioning, where applicable, the sources of the Content as well as not to use Content deriving from illegal sources. The terms of use of sources from which the User displays any links to third-party content should at least permit the reproduction without subscription or any other form of remuneration;

(e) Where the UGC includes the images and/or any other personal data of third parties, you are the sole responsible party to ensure that the third parties have granted their free and informed consent to include that third party personal data in the UGC, before uploading it; you are responsible to provide appropriate proof when so requested.

(f) Without limitation, you represent, warrant, agree, and guarantee that you shall not upload any UGC (or link to any third-party content) nor proceed to any action in or through the Platform that is illegal. Indicatively and non-exhaustively, and will not post nor act in any way that:

(i) violates any law, statute, ordinance, or regulation; or
(ii) is threatening, harassing, or promotes racism, bigotry, or hatred of any kind against any group or individual; or
(iii) promotes or encourages violence against a person or damage or destruction of property; or
(iv) is inaccurate, false, or misleading in any way; or
(v) promotes any illegal activities; or
(vi) contains software viruses or any other computer code, files, or programs designed to interrupt, destroy, or limit the functionality of any computer software or hardware, or telecommunications equipment; or
(vii) contains any professional, advertising, promotional materials, “junk mail,” “spam,” “chain letters,” “pyramid schemes,” or any other form of solicitation; or
(viii) infringes the personality right as well the right of privacy and/or protection of personal data; or
(ix) promotes unfair competition and unfair commercial practices and/or violates competition rules
The above reflect solely examples of prohibited material and are not intended to be exhaustive of what constitutes prohibited User Generated Content.

7.4. Each User acknowledges that he/she bears the responsibility to compensate, defend, hold harmless, and exempt the Platform and its directors, officers, employees, consultants, representatives, and affiliates from any, and all, claims by third parties’ liability, damages and/or costs (including, but not limited to legal consultants’ fees) which occur as a result of or in connection with the UCG they upload or from the breach of the present terms or in case any other User or third party turns against the Platform in relation to any Content they have uploaded to the Platform or in connection to the use of the Platform or the Services. In addition, Users acknowledge that they shall respect the notice and take-down process of the Platform set in Article 8.

  1. Notice & Take Down

8.1. Dottely has the right (not the obligation) under the present terms and the applicable laws to check and suspend (Notice & Take Down) temporarily or permanently (delete), reviews of Registered Users after claims regarding the content of the reviews infringing law.

8.2. Anyone who wants to send to Dottely a claim against any UGC posted requesting to take it down (notice and take-down process - as provisioned in the law), should ensure this claim is specific, well identified, and explained; it also needs to be adequate to establish reasonable grounds under the present terms and the applicable laws to take down that UGC.

8.3. A Take-down notice should must:

(i) contain the complaining party’s contact information,
(ii) identify the content UGC(s) violating those rights,
(iii) include a physical or electronic signature of a person authorized to act on the rightsholder’s behalf,
(iv) include a statement that the complaining party has a good faith belief that the infringing material is not authorized by the copyright owner, the copyright owner’s agent, or law,
(v) include a statement that the information in the notice is accurate and, under penalty of perjury, that the complaining party is authorized to act on behalf of the rightsholder.

8.4. For the purposes of the notice & takedown process, the Platform has designated, as an agent for the receipt of notifications of claimed infringements, Christopher Pappas with contact information [email protected]

8.5. Notwithstanding the above, we shall proceed to suspension or termination of any content further to a Court or a Competent Authority order.

  1. Intellectual Property

9.1. By the submission of any UGC the rating or/and text you provide Dottely a world-wide non-exclusive, perpetual, royalty-free license to reproduce, modify, translate, and/or publish the text in the Platform and/or in other Platform-related means (such as indicatively social media pages of the Platform, advertising, and promotion material and/or means, etc).

9.2. Platform and all the texts included in it (but to the content regarding the Marketing Software tools and the UGC), the images, logos, database, graphics, reviews, software, data, and the selection and arrangement thereof are the proprietary property of Dottely and are protected by applicable intellectual property laws.

9.3. Dottely logo and Services names and slogans displayed on the Platform are registered trademarks of the Company and may not be copied, imitated, or used, in whole or in part, without the prior written permission of Dottely. Additionally, the look and feel of Dottely may not be copied, imitated, or used without the written permission of Dottely. All other trademarks, registered trademarks, product names, and company names or logos mentioned in the Platform are the property of their respective owners. Reference to any products, processes, or other information, by trade name, trademark, manufacturer, supplier, or otherwise does not constitute or imply endorsement, sponsorship, or recommendation thereof by Dottely.

9.4. By providing access and by allowing the making of use the search engine, the tools, and the respective forms for reviews that Dottely provides, the User or any other third party is not given ownership of any of the Company’s intellectual property rights to any of the aforementioned features. Dottely is the sole owner of all intellectual property rights in and to the Platform, its features, tools, and Services including updates, copies, improvements, enhancements, derivative works, and modifications thereof. The rights to use the Dottely are limited to those expressly granted hereby. No other rights with respect to the Platform or any related intellectual property rights are granted or implied.

9.5. Platform bears no liability in connection with any User Generated Content that is uploaded by Users Providing Ratings & Reviews, in violation of any Platform Users’, Vendors, and/or other third parties’ intellectual property rights. Platform bears no liability for any dispute that may arise between the Platform Users, Users Providing Reviews, and Vendors on the one hand and any third party on the other, regarding intellectual property rights in relation to the Content/reviews uploaded by the relevant Users on the Platform.

9.6. All Users browsing and having access to Content in the Platform are expressly prohibited to engage in any unlawful act which may undermine the rights of the Users Providing Ratings & Reviews or right holders of the Content uploaded at the Platform. Indicatively, but not exclusively, Users are prohibited from engaging into any unlawful act or omission, including (but not limited to) the following activities:

    • Recording and direct or indirect, temporary or permanent reproduction of the Content by any means and in any form, in whole or in part.
    • Translation of the Content.
    • Arrangement, adaptation, or other alteration of the Content.
    • Unauthorized and/or illegal distribution to the public in any form by sale or otherwise.
    • Renting and public lending of the original or copies of their work.
    • Public performance of the Content.
    • Transmission or retransmission of the Content to the public by radio and television, by electromagnetic waves or cables or pipes or other material in any other way, parallel to the surface of the earth or through satellites.
    • Any other act or action contrary to these Terms & Conditions.
  1.  Legal Nature of the Platform - Disclaimers – Limitation of Liability

10.1. Legal nature of the Platform: The Platform principally acts as a search engine/ intermediary service provider that hosts and stores information and data that: a) are either available online on third-parties' websites and/or b) are created by Users and/or Registered Vendors, respectively; information regarding the marketing software tools are listed under the logic laid down in details in these T&Cs. The Platform in principle acts as the automated, technical, and neutral host of the information and the professional data of the Marketing Software tools hosted in the Platform, as well as of the UGC. Given the nature of the Platform and of the information hosted in the Platform, it is not possible for the Platform (and it is under no legal obligation) to constantly monitor the content in the Platform nor to actively seek facts or circumstances to confirm intellectual property rights and monitor for all inappropriate or illegal activity. However, the Platform takes reasonable precautionary measures (including but not limited to the Notice & Take Down process of Art. 8) to prevent and/or prohibit evident illegal activity. It is clarified also that the Platform is not intended to act and should not be regarded as a publisher.

10.2. No endorsement:  The Platform does not endorse any of the content/reviews uploaded by the Users Providing Reviews in the Platform nor the User Generated Content. Also, it is not responsible for the information and professional data regarding the Marketing Software tools and it does not provide any guarantee explicit or implied regarding those tools. Providers of those tools (Vendors) are the only ones responsible regarding the tools including but not limited to the accuracy, lawfulness, and truth of the statements and the descriptions of the tools, their characteristics, and their pricing as well as all warranties and guarantees (legal and/or commercial ones) related to the sale of the tool. In any case whatsoever the Platform declares that hosting of any Marketing Software tool in the Platform does not constitute and suggestion nor promotion to purchase that tool of any kind.

10.3. Hyperlinks and re-direction to third-party websites: The Platform, Users Providing Ratings & Reviews, Registered Vendors’ and/ or User Generated Content uploaded in it may contain hyperlinks (links) to third-party websites. The platform does not control nor review the information and the content of that third-party websites nor does it warrant the continuous and safe accessibility to them and the sale of the products/services included in those websites. Each User accesses those third-party websites at his /her own exclusive risk, subject to its own (third-party website) terms and conditions

10.4. Both Registered Vendors and Users have access to the information and the UGC hosted in the Platform under the understanding of all the above and bearing their own responsibility in assessing the information provided. In case they need further information about the Marketing Software tools they are urged to contact directly the Vendor and/or visit the Vendor’s (third party) website.

10.5. The Platform is provided “as is” and “as available” using a commercially reasonable level of skill and care. Except as expressly stated in these Terms & Conditions, Platform does not provide and expressly disclaims warranties, conditions, or undertakings of any kind in relation to the Services, either express or implied, including, without limitation, warranties of merchantability and fitness for a particular purpose. No advice or information, whether oral or written, obtained by Users from Dottely or through the Services will create any warranty not expressly stated or incorporated herein. Without limiting the foregoing, Dottely, its subsidiaries, its licensors, and affiliates, do not warrant that any Content is accurate, true, reliable, correct, or complete.

10.6. Neither the Company nor any person associated with the Company makes any warranty or representation with respect to the completeness, security, reliability, quality, accuracy, or availability of the Platform. Without limiting the foregoing, neither the Company nor anyone associated with the Company represents or warrants that the Platform, the content obtained through the Platform will be accurate, reliable, error-free or uninterrupted, that defects will be corrected, that the Platform or the server that makes it available are free of viruses or other harmful components or that the Platform will otherwise meet your needs or expectations.

10.7. We undertake reasonable efforts and technical measures so that access to the Platform can take place smoothly and without interruption and that an adequate level of security is maintained. However, we do not guarantee that the Platform will be available without interruption and without errors. We are not liable, though, if for any reason, negligence included, despite the maintained security measures adopted by us, the operation of the Platform is interrupted or access to the Platform or the Registered User Accounts becomes difficult and/or impossible, or if viruses or other harmful software is identified and transmitted to the terminals of the users/visitors, or if third unauthorized parties intervene in any way to the content and operation of the Platform making the use of it difficult or causing problems to its proper function. Moreover, we are not liable if the Platform is not accessible for reasons beyond our control as well as for reasons due to technical or other failure of the backbone network or for reasons of force majeure or incidental facts. In case of any loss or damage of the content, our sole liability and responsibility will be to repost the content to the extent technically feasible from our periodic back-ups.

  1. Miscellaneous

11.1. Changes to the Terms & the Platform: Dottely reserves the right to:

(a) change at any time, without justification, partially or in total these Terms and Conditions, the features and Services provided, Dottelys, functionalities as well as its versions or the provided content and features, prior to a fifteen (15) days’ notice in our Platform and through an e-mail, should these changes materially affect the way you interact with Dottely,
(b) renew or upgrade or restrict/stop partially or in total, some or all of the content displayed on the Platform,
(c) renew or upgrade part or all of the external appearance (interface), structure, or composition (configuration) of the Dottely and its technical specifications, (d) limit access to all or part of the Platform,
(e) cancel, suspend permanently or temporarily or terminate the operation of the Platform or to modify the way the Platform operates

11.2. Severability: In the event that a term of the contract is found to be abusive or is canceled, this does not affect the other terms of the contract which remain valid and binding on the parties. If any part of the Terms and Conditions is found to be invalid, void, or unenforceable (including any provision in which we exclude our liability to you), the enforceability of any other part of the Terms and Conditions will not be affected - all other terms will remain in full force and effect. In any event, where it is possible for a term/sub-condition or part of a term/sub-condition to be considered separately in order to make the remaining part valid, the term will be interpreted accordingly. Otherwise, the parties agree that the term should be corrected and will be interpreted to approximate as closely as possible the original meaning of the term/sub-term in accordance with the law.

11.3. No Waiver: Any delay by either party in exercising some or all of its rights under these terms and conditions shall not impair or waive that right, which may be exercised at any time thereafter at the reasonable discretion of the beneficiary.

11.4. Complaints: We urge you to address any issues relating to (i) alleged non-compliance by Dottely with any legal obligations, especially with respect to measures taken by, or of Dottely that affect you, and (ii) technological issues which relate directly to the provision of our Services to you, directly to us by submitting your complaint at [email protected], so that we can try and handle them internally towards a mutually acceptable resolution.

11.5. Mediation: In case we cannot work out the dispute among us, we mutually agree to try and resolve any disputes arising with regard to these Terms amicably and in good faith. To that effect, the Parties will attempt to solve their differences through mediation, by recourse to the flexible dispute settlement/mediation process of Law 4512/2018. This, however, does not affect the rights of either Party to initiate judicial proceedings at any time before, during, or after the mediation process.

  1.  Applicable Law and Jurisdiction

These terms are considered as terms between business (B2B) and are governed by and construed according to the laws of Greece. Both Users and Platform agree and understand that they are subject to the exclusive jurisdiction of the courts of the city of Athens in Greece.
